1. Introduction
Welcome to Contactly, a mobile application developed by MyLead S.L. (“Company”, “we”, “us” or “our”). These Terms and Conditions ("Terms") govern your use of the Contactly app ("App"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you confirm that you meet this requirement.
3. Account Registration
To use Contactly, users must register an account with a nickname, email address, and phone number. You agree to provide accurate information and to keep it current. You are responsible for all activity under your account.
4. Features
Contactly allows users to:

Link contacts with notes, files, audios, events, billing data, social profiles, and links

Use private and team-based repositories

Access a contact marketplace

Communicate via Contactly Chats

Share content with contacts or teams
5. Subscription Plans and Payments
Contactly offers the following plans:
5.1 Standard – €8.49/month

Ability to share with contacts
5.2 Teams – €11.99/month

Designed for collaborative use within small teams
5.3 Owner – €144.99 one-time (lifetime access)

Lifetime access to all current and future features

Unlimited cards, contacts, and chats

Ability to share with contacts, teams, and through the marketplace
5.4 Payment Terms
All purchases are processed via the Apple App Store or Google Play Store.
Subscription payments are charged to your account upon purchase and renew automatically unless canceled at least 24 hours before the end of the billing period.
Lifetime purchases are charged once and grant perpetual access to paid features.
5.5 Refund Policy
Refunds are handled according to the policies of the App Store or Google Play Store. Please refer to your store provider for more information.
6. User Responsibilities
Users may not:

Violate any laws or regulations

Share false or misleading information

Infringe on intellectual property rights

Upload harmful or offensive content
-
Interfere with other users' experiences or access
7. Content Ownership and License
You retain ownership of any content you upload. However, you grant the Company a non-exclusive, worldwide license to use, display, and share your content as necessary for providing the App’s services.
8. Privacy
Your personal data is processed in accordance with our Privacy Policy. By using the App, you consent to the collection and use of your information as described therein.
9. Cloud Infrastructure and Data Loss Disclaimer
All data stored or processed by the App is hosted in secure environments through Amazon Web Services (AWS). While we employ industry-standard security protocols and take all reasonable steps to protect your data, you acknowledge and accept that no system is completely immune to failure, unauthorized access, or loss.
Accordingly:

We do not guarantee the integrity or availability of your data at all times.

We are not responsible for any partial or total loss of data due to factors such as hardware failure, cyberattacks, data corruption, service interruptions, or force majeure events.

You are solely responsible for maintaining backup copies of your important content or records.
By using the App, you expressly release the Company from any claims related to data loss or service unavailability.
10. Termination
We may suspend or terminate your access to the App at any time, without notice, for conduct that violates these Terms or is harmful to other users or the Company.
11. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or completely secure.
12. Limitation of Liability
To the maximum extent allowed by law, the Company will not be liable for any indirect, incidental, or consequential damages resulting from your use of the App, including but not limited to:

Data loss

Business interruption

Unavailability of the service

Errors or omissions in content
13. Changes to Terms
We reserve the right to modify these Terms at any time. If changes are made, we will notify users via the App or by updating the "Last Updated" date. Continued use of the App after changes means you accept the new Terms.
14. Governing Law
These Terms shall be governed by the laws of Spain, without regard to its conflict of law rules.
